A nonprofit organization focused on AI advocacy has joined forces with Tesla CEO Elon Musk in opposing OpenAI’s plan to convert into a for-profit company. The move is seen as a significant development in the ongoing debate over the potential risks and consequences of OpenAI’s transformation.
Encode, a network of volunteers dedicated to ensuring younger generations have a voice in AI-related discussions, has filed an amicus brief (a friend-of-the-court brief) in support of Musk’s lawsuit against OpenAI. The brief argues that allowing the company to convert into a for-profit entity would be detrimental to the public interest and potentially harm humanity.
Encode points out that as a nonprofit, OpenAI is bound by law to prioritize “the public benefit” over the interests of its investors. However, if it converts into a for-profit company, this duty would evaporate, leaving the company free to prioritize profits over safety considerations.
The brief also raises concerns about the potential loss of control and oversight that could occur if OpenAI’s nonprofit board is replaced by a for-profit management team solely focused on maximizing shareholder value. This shift in priorities could put at risk the development of safe and beneficial AI technologies, which has been a core mission of OpenAI since its inception.
