Can Trump Stop TikTok Ban?
Former President Donald Trump and his administration have been vocal critics of the popular social media app TikTok, which is owned by Chinese-based company ByteDance. However, even if the ban on TikTok is upheld by the Supreme Court, there are certain limits to what Trump or any other individual can do to stop it.
As previously reported, Forbes has obtained court documents showing that Trump’s own Department of Justice (DOJ) did not argue in favor of banning TikTok during the case. Instead, the administration was supportive of a more nuanced approach that would have allowed ByteDance to continue operating the app while separating its US-based operations from those based in China.
If the Supreme Court upholds the ban, it remains unclear what Trump or any other individual can do to stop it. However, some legal experts have suggested that Trump could potentially use his executive authority to intervene in the situation.
One possibility is that Trump could try to pardon TikTok CEO Zhang Yiming, who has been a vocal critic of the ban and its potential impact on creators who rely on the platform for their income. However, as Forbes notes, this would likely be seen as an attempt to circumvent the law rather than address the underlying concerns that led to the ban.
Another possibility is that Trump could try to intervene in any potential appeals or re-litigation of the case by TikTok or ByteDance. However, it’s unclear what legal authority he has to do so and whether such intervention would be seen as appropriate given the court’s ruling.
In practice, any attempts by Trump or others to stop the ban are unlikely to succeed, especially if the Supreme Court upholds the law.
