
Hester Peirce Pushes SEC Rulemaking to Cement Crypto Regulation Under Trump
U.S. Securities and Exchange Commission (SEC) Commissioner Hester Peirce has emphasized the importance of formal rulemaking to ensure long-term crypto regulation, particularly under the Trump administration. Speaking at the DC Blockchain Summit on March 26, Peirce stressed that agency rules should replace informal guidance to avoid regulatory confusion.
As the head of the SEC’s crypto task force, Peirce emphasized the need for clear standards on digital assets and how developers can proceed legally. She believes that rulemaking would give the industry a stable foundation to work on, regardless of which party controls the SEC.
In her speech, Peirce highlighted the significance of SEC rulemaking in providing consistency under changing political leadership. She compared current guidance with permanent SEC rulemaking, noting that recent non-binding views from the SEC have created uncertainty among stakeholders. These views include statements declaring memecoins do not qualify as securities.
Formal rulemaking would grant developers more confidence when building blockchain-based projects, according to Peirce. The commissioner emphasized that it is crucial for crypto regulation through proper rulemaking to provide a stable base for the industry to operate on, regardless of which party controls the SEC.
As the Trump administration shapes federal policy on crypto assets, these calls for clear rules come as the SEC’s crypto task force and leadership adjust enforcement actions. Recently, the agency dropped investigations or lawsuits involving Coinbase, Ripple, Kraken, and Immutable following the appointment of Mark Uyeda as acting SEC chair.
In an effort to solidify regulatory clarity, Peirce advocates for combining SEC rulemaking with congressional law. She did not provide specific details on proposed rules or bill provisions, but emphasized the importance of bringing crypto regulation into a clearer framework.
