
XRP Case Update: Ex-SEC Lawyer Reveals When the Regulator Could Officially End Appeal
Former SEC enforcement attorney Marc Fagel has shed light on the ongoing lawsuit against Ripple, clarifying when the regulator could officially end its appeal. In a recent tweet, Fagel addressed speculation surrounding an imminent conclusion to the case.
The rumor mill began circulating that the Securities and Exchange Commission (SEC) might make an announcement at any moment, prompting Fagel to set the record straight. “Not on a weekend, they won’t,” he tweeted, pointing out that legal processes inside the SEC take time. He emphasized, “it typically takes a month or two to vote on an enforcement recommendation.”
While some XRP supporters had hoped for an immediate resolution, this update reveals that the wheels of regulatory enforcement indeed turn slowly but surely.
For context, Ripple announced its willingness to drop its cross-appeal on June 27th. However, the SEC has yet to formally withdraw its appeal. Fagel explained that the regulator must first conduct an internal vote to decide whether to abandon its lawsuit. This step has not been taken yet, thereby keeping the appeal technically in effect.
Once this process is complete and the SEC decides to drop its appeal, both parties will jointly notify the court of their intention to withdraw the appeal. It is at this point that Judge Analisa Torres’ previous judgments and penalties will finally take hold, effectively concluding the case.
