Donald Trump has asked the Supreme Court to allow him to intervene and negotiate a deal to save TikTok from a US ban, stating he alone possesses the “consummate dealmaking expertise” to resolve the issue.
In an amicus brief filed with the court, Trump emphasized that he seeks the ability to resolve the issues at hand through political means once he takes office. This comes after the Supreme Court agreed to hear arguments that a bill passed by Congress, which would ban TikTok on national security grounds, violates the First Amendment.
Despite previously pushing for a TikTok ban during his first term, Trump has seemingly changed his stance after his successful campaign used the platform in 2024. The President-elect recently met with TikTok CEO Shou Chew at Mar-a-Lago and told a crowd that “maybe we gotta keep this sucker around for a little while.”
The bill in question gives wide latitude to the president to delay its enforcement if there’s progress being made towards a deal ensuring TikTok isn’t fully controlled by its Chinese parent company, ByteDance. However, the deadline for determining whether this is possible has been set for January 19th, just one day before Trump assumes office.
Trump’s filing with the Supreme Court asks that this deadline be stayed, arguing that any deal he would negotiate would obviate the need for the court to decide a historically challenging First Amendment question.
